WHAT IS FORM I‑130?

Form I‑130, Petition for Alien Relative, is used by certain U.S. citizens and lawful permanent residents (green card holders) to ask USCIS to recognize a qualifying family relationship with a relative who wants to immigrate. The I‑130 itself is not a visa or green card; it is the first step to show there is a real qualifying family relationship.

WHO CAN FILE AN I‑130 PETITION?

Only U.S. citizens or lawful permanent residents (LPRs) can be petitioners on Form I‑130. The family members they may petition for depends on their status:


If you are a U.S. citizen, you may generally file I‑130 for:

  • Spouse
  • Unmarried child under 21
  • Unmarried son or daughter age 21 or older
  • Married son or daughter of any age
  • Parent (if you are at least 21)
  • Brother or sister (if you are at least 21)


If you are a lawful permanent resident (green card holder), you may generally file I‑130 for:

  • Spouse
  • Unmarried child under 21
  • Unmarried son or daughter age 21 or older


Immigration law divides these cases into “immediate relative” and “family preference” categories, which affect waiting times for immigrant visas. Only a licensed attorney or accredited representative can advise you which category applies to you, how long you might wait, or whether you should file.

WHAT OUR FAMILY PETITION SERVICE INCLUDES

 We provide non‑legal assistance with family‑based petition forms, such as Form I‑130 and related documents:
